2. Definitions

“We, us or our” refers to Dealers in Performance 4×4 Ltd

“You, your or yours” refers to yourself, the customer or user of the website.

3. Product Information and Orders

3.1 – Upon placing an order, you are making an offer to purchase the goods, you will receive a confirmation email for any purchase.

3.2 – In the unlikely event an item has been incorrectly listed, is out of stock or has a pricing error, we reserve the right to inform you and cancel your order.

3.3 – Images. While the majority of images on our website are accurate, some may vary slightly from the actual product as well as other factors such as lighting and angle of the photograph. Additional items and accessories featured in any images other than the described product are not included unless otherwise stated.

3.4 – By placing an order, you agree to these terms and conditions in addition to our privacy policy and guarantee.

4. Order Process

4.1 – All products can be ordered by telephone on the number provided on listings or via email. Certain products can also be ordered online direct through our website if indicated on the product page.

4.2 – Upon ordering, you will receive a confirmation email confirming the details of your order. It is your responsibility to ensure all details on this email are correct.

4.3 – All goods must be paid for in full prior to dispatch.

4.4 – Delivery times do vary on certain products, delivery times will be listed on the product pages or checkout page.

5. Payment and Pricing

5.1 – All pricing is shown on our website is in pounds sterling.

5.2 – VAT inclusive AND exclusive pricing will be shown on our website for each product.

5.3 – Payment for all products must to made via credit/debit card, bank transfer or PayPal prior to us dispatching the goods. If the item is for fitting at our premises, a deposit may be taken to reserve the item. In this case the goods must be paid for in full before leaving the premises.

5.4 – All products remain the property of Dealers in Performance 4×4 until paid for in full.

5.5 – We reserve the right to amend the prices of our products at any point. Pricing will not be changed on orders once confirmed.

6. Delivery

6.1 – All our products are delivered via our own vehicles or by reputable UK couriers.

6.2 – Delivery times on our products will vary on product type and colour. delivery times will be shown on each product page. If a time scale is not indicated, please contact one of our sales staff.

6.3 – DAMAGED GOODS. Upon receipt of delivery it is your responsibility to thoroughly check the goods before signing for “in good condition”. If the delivery driver is unwilling to wait, simply sign as damaged and inspect the goods at the earliest opportunity and inform us immediately of any damage that may have occurred. We must be made aware of any damage within 25 hours of delivery.

7. Cancellations

7.1 – Orders placed through our website or via telephone may be cancelled up to 14 days of receipt of the goods. This does NOT apply to orders that have been specially modified or  “built to order” or items that have already been fitted to a vehicle. Once a custom upgrade has been applied to an order, any labour costs incurred are non refundable.

8. Refunds

8.1 – If you cancel an order and are entitled to a refund, the refund will be processed as soon as possible via the original method of payment.

8.2 – Refunds will be processed within 30 days.

10. Statutory Rights

10.1 Nothing in these terms of sale will affect your statutory rights as a consumer.

11. Trade or Business Customers

11.1- The following conditions apply to orders placed by Trade or Business Customers.

11.2 – Orders may not be cancelled except with our mutual agreement and having been confirmed in writing by a Director of our company.

11.3 –  Claims for missing or damaged items must be made in writing within 2 working days of delivery.

11.4 – The buyer assumes responsibility for the goods being suitable for the purpose for which they are purchased

12. International Orders

12.1  We accept only direct bank transfer for all orders from outside of the UK. We are not reposonsible for any Duty or Taxes charged to the customer by their relevant countries tax /import regulations.

12.2 We can not refund the costs of delivery for interntional returns where the products is not defective.
